3. Acceptance of the Terms

By accessing and using the Site, you agree to comply with and be bound by these Terms and Conditions and by all applicable laws and regulations. If you do not accept these terms, please do not use our Site.

4. Products and Services

We offer a range of products with original designs created by us, some of which are printed to order. The right of withdrawal applies as set out in the Refund policy. All products are subject to availability, and we reserve the right to limit the quantities of any product we offer. We also reserve the right to stop selling any product at any time.

5. Prices and Payments

All prices are in euros (EUR) and include VAT. Shipping costs, when due, are shown separately before you confirm the order. We accept: credit and debit cards (Visa, Mastercard, American Express, Maestro, UnionPay), PayPal, Shop Pay, Apple Pay, Google Pay, Klarna, MobilePay and BLIK. For orders shipped outside the European Union, duties and taxes may be due on arrival, payable by the recipient.

6. Orders

To place an order, you must be at least 18 years old and provide valid and up-to-date personal information. Once you have placed your order, you will receive a confirmation by email. We reserve the right to refuse any order for any reason.

7. Shipping and Delivery

We ship to Italy, to all European Union countries, to the United Kingdom, Switzerland, Norway and Iceland, and to the United States, Canada, Australia and New Zealand. Times, costs and methods are set out in the Shipping policy, which forms an integral part of these Terms.

8. Withdrawal, Returns and Guarantee

Withdrawal, returns and the guarantee are governed by the Refund policy, which forms an integral part of these Terms. You can also withdraw online, using the “Withdraw from contract here” function at the bottom of every page.

9. Damaged or Wrong Product

If you receive a product that was damaged in transit or is different from the one you ordered, write to us at info@rockmusicawords.com as soon as you notice, with photos of the product and the packaging: we will replace it or give you a full refund, and we pay the return costs. Lack of conformity is covered by the legal guarantee: you will find the conditions in the Refund policy and the EU notice on the page www.rockmusicawords.com/en/pages/garanzia-legale.

10. Intellectual Property

All content on the Site, including text, graphics, logos, images and software, is the property of Rock Music aWords Merch or of our content suppliers and is protected by copyright and trademark laws. You may not use, reproduce or distribute any content without our express written consent.

11. Limitation of Liability

Within the limits allowed by law, except in cases of wilful misconduct or gross negligence, and without prejudice to the rights that the law grants to consumers, Rock Music aWords Merch will not be liable for indirect, incidental, special or consequential damages arising from the use of, or the inability to use, the Site or our products.

12. Changes to the Terms

We reserve the right to change these Terms and Conditions at any time. Changes take effect immediately after they are published on the Site. Continued use of the Site after such changes means that you accept the new Terms and Conditions.

13. Governing Law and Jurisdiction

Contracts concluded on this website are governed by Italian law. If you are a consumer, the more favourable provisions of the law of the country where you live still apply.

In the event of a dispute, if you are a consumer, the competent court is the court of the place where you live or are domiciled, if that place is in Italy. If you live in another European Union country, you can bring proceedings before the courts of your country or of Italy, and we can bring proceedings against you only before the courts of your country (Regulation (EU) No 1215/2012, Articles 17-19).

For customers who are not consumers (purchases with a VAT number), the competent court is the court of Ancona.

Before going to court, you can contact us at info@rockmusicawords.com: we always try to settle every problem amicably. If you are a consumer living in another European Union country, you can contact the European Consumer Centre of your country free of charge (in Italy: ecc-netitalia.it).
